TERMS AND CONDITIONS OF TRAVEL WITH ADELAIDE RIVER TRANSFERS AND ASSOCIATED THIRD PARTY OPERATORS.
These terms and conditions form the basis of the contract between You and QALLIOPE Australia Pty Ltd, trading as Adelaide River Transfers. It is important that You read the Terms and Conditions carefully to ensure that You understand Your rights and obligations.
You confirm Your understanding and acceptance of the Conditions and the Terms by paying Your Booking Deposit or otherwise paying any part of the price of Your Tour.
If You make a Booking on behalf of any other person, You represent to Us that You have their authority to make the Booking on their behalf and to legally bind them to the Terms and Conditions. Each reference to “You”, “Your”, “Guest” or “Passenger” means the person who makes the Booking and each other person covered by the Booking.
Your transportation on any Tour, provided by a third party operator that is a separate legal entity and business and any information provided is done so with the understanding that the information may have been provided by the third party and should therefore only be used as a guideline. Adelaide River Transfers may use third party operators, suppliers or providers of some services and products and as such acts as agents for those. Any claim or liability resulting from those services or products is the responsibility of the operator, supplier or provider.
Booking and Payment
Bookings are made directly with us (Adelaide River Transfers). Your Booking will be confirmed only when we have received:
Your Booking Deposit (for charters); or the Tour Price and all other amounts payable (for individual passenger bookings)
You must pay Your Booking in full within 24 hours of your tours scheduled departure.
If We do not receive Your Booking Deposit within 24 hours, We will automatically cancel your Booking without further notice to You.
Booking Deposits are not refundable and are not transferable to other Tours or Bookings.
- If you cancel at least 14 days in advanced of the scheduled departure, there is no cancellation fee.
- If you cancel between 13 and 7 days of the scheduled departure, there is a 50 percent cancellation fee.
- If you cancel within 7 days of the scheduled departure, there is a 100 percent cancellation fee.
- If however you are traveling on a cruise ship and your ship is unable to dock on the day of your excursion, all monies prepaid will be refunded.
Prices, inclusions, and fees
All Tour Prices are quoted in Australian Dollars (AUD).
If You pay by credit card, the following surcharges will be added:
- Eftpos 1.5%
- Debit Card 1.5%
- Visa 1.5%
- Mastercard 1.5%
- American Express Not Accepted
- Diner Not Accepted
There is no surcharge for payments made by cash or direct transfer to Our nominated bank account.
Cheques are not accepted.
Included in your tour price is the following. Pick up and Drop off from either out primary location, (Bus Stop on the corner of Smith Street and Bennett Street, Darwin City) or select prearranged hotels around central Darwin City, Manigurr-Ma Village, and select prearranged locations. And a one-hour jumping crocodile cruise with The Original Adelaide River Queen.
Pick up and Drop off from any location which is not our primary location (Bus Stop on the corner of Smith Street and Bennett Street, Darwin City) must be prearranged directly with Adelaide River Transfers. Full payment for pickups not at our primary location must be made to secure pick ups. No shows at time of pick up are not eligible for refund or change of tour date.
Unless expressly listed in Your Itinerary as an inclusion, Your Tour Price does not include airfares; airline taxes; gratuities on venues, tours; additional optional activities; meals; drinks; vaccinations; medical assistance; government taxes and charges (excluding GST); or any items or expenses of a personal nature.
We reserve the right not to honour any published prices that We determine were incorrect due to printing, electronic, or clerical error. If You make a Booking based on inaccurate pricing, We will offer You the option of cancelling the Booking and receiving a refund of any amount paid by You directly to us or confirming the Booking by paying the difference between the erroneous price and the correct price, as determined by Us.
The following Fees are payable in addition to the Tour Price:
- If You cancel Your Tour for any reason prior to Your Tour Departure Date, You will be liable for the following cancellation fees:
- If you cancel at least 14 days in advanced of the scheduled departure, there is no cancellation fee.
- If you cancel between 13 and 7 days of the scheduled departure, there is a 50 percent cancellation fee.
- If you cancel within 7 days of the scheduled departure, there is a 100 percent cancellation fee.
- If however you are traveling on a cruise ship and your ship is unable to dock on the day of your excursion, all monies prepaid will be refunded.
We may vary Your Tour Price at any time before You have paid the Tour Price in full to the extent necessary to meet any increase in the Tour costs for reasons outside Our control, including fuel, government taxes, and charges, exchange rate fluctuations, or other Tour related costs or tariffs. We will not vary the Tour Price after We have received the total Tour Price from You, regardless of any increases in the costs incurred by Us. We will notify You of any such variation using passenger contact details provided at the time of booking.
Cancellation, delays, and changes to Your Itinerary
Your Booking is conditional on Us receiving a minimum number of tour passenger bookings to operate the Tour and ensure an enjoyable group atmosphere. Where sufficient numbers cannot be achieved, We may cancel or delay a scheduled Tour or Tour Departure Date.
We will endeavour to make any decision to cancel or delay a Tour or Venue, and to notify You of that decision, at our earliest opportunity prior to the scheduled Tour Departure Date. Tours can be cancelled up to 1 (one) hour prior to departure.
If We cancel a prepaid Tour, for whatever reason, before departure:
We will endeavour to offer You the closest available confirmed tour date and time. If You accept the proposed alternative tour, Your Itinerary will be amended accordingly and We will give You an updated Itinerary;
If You do not accept the proposed alternative tour, We will cancel Your Booking, refund to You all monies paid directly to Us and will have no further liability to You; and We are not liable for any third-party costs You may incur, which We have not booked on Your behalf, for example airfares or other arrangements booked independently through or paid to a travel agent.
Alterations to Your Itinerary or the Tour may include:
- Substitution of vessels or vehicles
- Substitution of alternate transportation, including the use of motor coaches;
- Alterations to arrival and departure times;
- Reductions or increases in the time spent at a location.
Any changes to Your Itinerary will be notified to You by phone or email using the Passenger Contact Details; or if during Your Tour, personally by Your Cruise Director or Tour Director.
To the maximum extent permitted by law, You agree that We are not liable to You for, and You release Us from, any cost, claim, loss, damage or expense whatsoever arising either directly or indirectly in connection with any alteration to Your Itinerary or substitution carried, including without limitation any:
Claim for distress, disappointment or loss of enjoyment arising from the alteration;
Additional personal expenses incurred by You, including for food, beverages and personal items; or Costs associated with any other travel arrangements affected by the changes, including any costs and expenses incurred by You for cancelling or changing those other arrangements or arising from a failure to meet a connection.
Your Tour obligations
For the comfort and safety of You and Your fellow passengers and other people, You must follow the Tour Director’s and venue Director’s instructions at all times.
If We, the venue Director, the Tour Director or Our staff or any Service Provider consider You are negatively affecting Your own health, safety or enjoyment, or that of other passengers, including by refusing to comply with instructions of the Tour Director or the venue Director, We may terminate your booking and withdraw You from the Tour with immediate effect. If it is reasonably practicable to do so, the Tour Director or venue Director will provide a warning to You and allow You an opportunity to rectify Your behaviour before We withdraw You from the Tour.
For Your safety, the safety of other passengers, venue Director, the Tour Director or Our staff or any Service Provider, intoxicated persons will not be carried. If deemed intoxicated you will be refused carriage and no refund will be given.
If You are withdrawn from the Tour, You must make Your own travel and other arrangements at Your own expense and We are not liable to You for any loss, cost, or damage You may suffer or incur.
Notification of General Risks
You acknowledge and agree that there are general risks associated with travelling, which are beyond Our control and We are not liable to You for any loss, cost or damage You may incur as a result of these general risks. Such general risks include:
- Tour variations or interruptions caused by road, river or weather conditions; national or local holidays affecting the closure of public buildings and attractions; Force Majeure Events; high water levels; low water levels; flooding; unscheduled vessel or vehicle maintenance;
- Forces of nature; illness; flight schedule changes or cancellations; loss of luggage; epidemics or pandemics; political unrest; accidents; acts of terrorism or other criminal acts; changes to government visa or travel requirements; or
- Other circumstances beyond Our control.
You acknowledge and agree that where the Tour, any part of the Tour, are not directly provided by Us, but is provided by a Service Provider, in the event of any dispute or claim including for loss, damage, breach of contract or negligence arising from the conduct of the Service Provider, You must pursue Your claim directly against the relevant Service Provider.
Liability
You acknowledge and agree that We accept no responsibility and will not be liable to You (or any third party) for any loss, cost, or damage (including loss of enjoyment) suffered directly or indirectly in connection with:
- any Tour risks or other aspects of the Tour;
- any change to Your Itinerary or delays in departure or arrival times;
- any loss or damage to Your baggage or belongings;
- any personal injury or death resulting from the acts or omissions or negligence of any third parties providing goods or services to You during the Tour; or
- any disappointment or loss of enjoyment due to circumstances outlined or otherwise beyond Our control.
We strongly recommend that You take out comprehensive travel insurance with a reputable insurance company to cover You against risks associated with Your Tour including cover for loss of luggage, medical expenses, costs, and expenses incurred due to cancellations, delays or other disruptions.
Privacy and Data Protection
In order for Us to process Your Booking and provide the Tour to You, You will need to provide to Us, and We will need to use Personal Information. We will not provide you personal information to any third parties without your writer’s acknowledgment to do so.
We may also use Your name and the Guest Contact Details for marketing purposes, unless You tell Us that You do not want Us to do so. You may do this by contacting us directly.
We will otherwise deal with Your Personal Information in accordance with Our Privacy Policy.
Important Information About Your Tour
Smoking: Smoking is limited to designated smoking areas at venues and any other vessels and/or vehicles
You acknowledge that We may restrict smoking to specific times and locations during Your venue for the comfort of all passengers.
Smoking is not permitted on coaches or such other places as nominated by Us from time to time.
Although We will use reasonable endeavors to ensure there are opportunities for You to smoke during the Tour, We cannot guarantee such opportunities will be available.
For Your safety, the safety of other passengers, venue Director, the Tour Director or Our staff or any Service Provider, intoxicated persons will not be carried. If deemed intoxicated you will be refused carriage and no refund will be given.
The animals interacted with during your cruise are wild and untamed. For your safety and the safety of all passengers You must follow all instructions given by your tour guide. Tour guides reserve the right to terminate the tour of any person deemed to be endangering their life or the lives of other passengers.
Medical Services
Tours and venues do not carry a doctor however medical services may be called at Your own expense.
We are not, and Our Service Providers are not, liable regarding the provision of any medical care You may require or choose to accept during the Tour.
Coaches
Travel sickness: If You suffer from travel sickness, You should arrange medication or other alternatives to treat symptoms, as We cannot make allowances for this.
Babies in arms are carried free of charge on a parents lap. It is at the discretion of the driver and availability of room as to whether baby carriers or prams are able to be carried on coaches.
Children over the age of 12 months (1 year) are required to have a purchased seat even if they sit on a parent’s lap.
